At the CAPPO25 Conference in Sacramento, it was proudly announced that the 2025 leadership team for the San Diego Chapter would include Eleida Felix Yackel as Chapter Chair, Sabrina Brown as Vice Chair, and Merce LeClair as Secretary/Treasurer. We also extend our sincere appreciation to all the candidates who submitted for a leadership role—your interest and dedication to CAPPO San Diego are deeply valued.

Eleida Felix Yackel brings over 20 years of public procurement experience and currently serves as a Senior Contract Administrator with the City of Carlsbad Public Works Department. Her focus on public works contracting and chapter engagement continues to strengthen our professional community. Sabrina Brown, our new Vice Chair, is a Senior Management Analyst at the San Diego County Water Authority. With over 15 years of public sector experience, she’s known for her expertise in operational analytics and interagency collaboration. Merce LeClair, incoming Secretary/Treasurer, is the Contract, Grant and Procurement Manager for the City of San Marcos. She offers more than two decades of leadership in procurement, grants, and financial oversight.

🚛🌱 CARB Update: ACF Regulation Clarified

The following summary is based on the Municipal Equipment Maintenance Association (MEMA) Regulatory Bulletin dated February 20, 2025, shared by Bradley Northup, Public Works Superintendent – Fleet Operations, City of Carlsbad. It outlines clarification provided by the California Air Resources Board (CARB) on the Advanced Clean Fleets (ACF) regulation.

David Worthington, MEMA NorCal Chair and County of Santa Clara Fleet Manager, contacted CARB for guidance. We thank David for his initiative and Bradley for keeping our chapter informed.

Key Clarifications from CARB:

1. Sales Disclosure of Regulation Applicability Requirement

Are fleets required to continue including the following language on or with the Bill of Sale, sales contract addendum, or invoice?

"A vehicle operated in California may be subject to the California Air Resources Board Advanced Clean Fleets regulations. It therefore could be subject to requirements to reduce emissions of air pollutants. For more information, please visit the CARB Advanced Clean Fleets webpage at CARB ACF."

CARB staff response: All portions of the State and Local Government regulation for ACF are still in effect until further notice or the regulation is amended through the APA process. We recognize that the lack of enforcement on the High Priority and Drayage regulations impacts the hiring requirements for government fleets and are currently looking into this to see if changes are necessary.

2. Disclosure of Regulation Applicability to Hired or Dispatched Fleets

Are fleets required to continue including the following language in new hiring or dispatch contracts/agreements?

"Vehicles with a GVWR greater than 8,500 lbs. and light-duty package delivery vehicles operated in California may be subject to the California Air Resources Board Advanced Clean Fleets regulations. Such vehicles may therefore be subject to requirements to reduce emissions of air pollutants. For more information, please visit the CARB Advanced Clean Fleets webpage at CARB ACF."

3. Compliant Fleets Reporting Requirements
Are fleets required to continue to perform the following tasks?

• Check for verification that each fleet that will be hired or dispatched is listed on the CARB ACF webpage as a Compliant Fleet.
• Acquire a statement from fleets that are not listed stating their fleet is not subject to the High Priority and Federal Fleets and the State and Local Government Fleets regulation.
• Collect and retain verification documents and attestation statements on a calendar year basis.

4. Penalties

Will the penalty language be modified to absolve fleets from requirements that we can no longer comply with because private fleets no longer must comply with the regulation (e.g., hiring a vendor that is ACF compliant)?

5. CARB ACT Regulation

Will vehicle manufacturers’ ZEV percentage sales requirements remain in effect to ensure government fleets have ZEVs to purchase to meet compliance requirements?

CARB staff response: The ACT regulation is still in full effect, having received its waiver from the U.S. EPA in 2022, and is currently being enforced.
